US Judge Mandates Freedom of Abrego Garcia from Immigration Detention

A federal judge has ruled the prompt release of Kilmar Abrego Garcia from detention by ICE, finding his continued detainment lacks legal authority.

"Since his return from erroneous detention in El Salvador, he has been taken back into custody, again without legal justification," Judge Paula Xinis stated in her ruling.

The case stems from a erroneous deportation to El Salvador in March, which the government later admitted was an error. Following his return to the United States to face alien smuggling charges, he was detained in federal custody.

In her decision, the court pointed out that the government lacks a current deportation order, which effectively blocks them from deporting Mr. Abrego Garcia "for now."

The court challenge center on disputed assertions. While the former administration argues that Abrego Garcia is a member of the MS-13 criminal organization, he vehemently disputes this claim.

He has also pleaded not guilty to the smuggling counts, which are part of a separate criminal case in Tennessee.

The judge, who was overseeing his petition to removal in a Maryland district court, ruled that he must now comply with the conditions of his release from jail in Tennessee. This order effectively transfers his monitoring to the Tennessee court.
