Michael Jordan Testifies He ‘Wasn’t Afraid’ of Nascar in Antitrust Trial

Michael Jeffrey Jordan, introducing himself formally in a federal courtroom on Friday, stated that his competitive side and novelty within the sport motivated his effort with 23XI Racing to confront Nascar over alleged violations of competition laws.

Financial Stakes and a Will to Win

The owner disclosed operational insights of his racing venture, saying he invested $40 million of his own funds into the Cup Series operation co-founded with partner Polk and driver Hamlin.

“It fell to someone to act,” Jordan stated in the Charlotte courtroom. “As a newcomer, I had no fear. I felt I could challenge Nascar as a whole. From my perspective, the sport it needed to be looked at through a new lens.”

Central Issue: Charter Agreements and Contract Pressure

At issue is the end of a 2016 deal where Nascar granted each team a “charter”. The concept is similar to other major leagues with separately owned franchises, like the NBA’s Hornets or the NFL’s Panthers. The agreement was due to end in 2024 when Nascar insisted on teams renew their charters.

Jordan was on the witness stand for about sixty minutes and left the court to pandemonium, with fans and media clamoring for a glimpse or a picture of the sports legend.

Spearheading the Fight

Heather Gibbs detailed her push for indefinite franchises, which she said a formal letter to Nascar. She said the pressure of the signature deadline was problematic.

She said, Joe Gibbs first attempted to call and talk Nascar out of demanding signatures, but CEO Jim France declined the request.

“Please don’t force this on us,” Gibbs recounted Joe Gibbs told Nascar’s executives. She said France replied, “Whether I have 20 charters, that’s what I have. If I have 30, that’s the number.”
